One of the good things about attending in class broker training is listening to what is happening around the industry.? In this case it was a discussion about broker supervision in regards to advertising.? Brokers are ultimately responsible for what agents in their office advertise both in print and on-line.? In addition, Realtors? are required by the Code of Ethics Article 12 to be truthful and present an honest picture in their advertising.
The case brought to our attention in class is a property that was listed and advertised as professional remodeled.? The property looked great and the work may have been overseen by a contractor but there were no permits pulled for the work and the subcontractors were not licensed to do the work.? The buyer is suing both the listing agent and the brokerage for false advertising.?
Since this a current lawsuit the details couldn't be discussed in class but the basics were enough to make everyone understand? "puffery" on a listing could end you in a court of law or perhaps the real estate board.? Interestingly enough today my clients and I toured a home advertised as COMPLETELY renovated and yet as soon as we walked in we were looking at the original kitchen kitchen cabinents and tile.?? A second listing made claims about new kitchen cabinets which turned out to be the original cabinets painted white.
Needless to say when we say new it better mean the ink on the receipt is still wet, completely renovated really means it and permits are required when you are completing a major remodel.? You can bet I'm going to be looking closely at my advertising before it leaves my office.
